SEASONAL MARINA Policies and Procedures

General
The co-operation and observance of these policies and procedures by all patrons are solicited to ensure a pleasant,
peaceful and enjoyable holiday for everyone.
Fishing
1. Fishing in the Marina is not allowed. Fishing is allowed in the ponds.
2. Fish must be cleaned and the remains disposed of at the fish cleaning station at launch ramps.
Fuel and safety regulations
1. Do not fill your boat while moored at the dock slip or in the marina basin. The gas docks are the only
area where fuel can be dispensed. Anyone caught disregarding this rule will be subject to immediate
eviction without refund or compensation. In the result of a spill, the Ministry of the Environment is
called and you will be responsible for clean up costs if you were found to be refuelling your boat.
2. The regulations for refuelling as posted at the gas docks must be abided by without exception.
Vehicles
1. All vehicles, including all those of visitors must be parked in designated parking areas.
Parking or driving vehicles on grassy areas in the marina or park is prohibited.
2. Visitors may be required to pay for parking and/or park in designated locations.
3. All visitors must check in at the gate and receive the proper passes which must be prominently displayed on
the dash or rear view mirror of their vehicle. Seasonal visitor passes will be issued.
4. The speed limit in the trailer park and marina is 10 KM at all times.
5. Please observe the no wake zone at the channel entrance.
6. Motorized vehicles are not permitted on any docks or grassy areas. Damage to the grass or underground
facilities could result.
7. ATV’s must be plated & insured to enter the park and the driver must have a valid driver’s license as per the
Highway Traffic Act.
8. Golf carts must have a Golf Cart Pass indicating your slip or site number that will be provided by the office.
Failure to post Golf Cart Pass on your cart can result in loss of golf cart privileges. Carts must have
lights after dark, slow-moving signs are desirable. Liability insurance must be carried and a copy supplied to
the office.
Pets
1. Pets are not permitted to roam free.
2. Pets must be leashed and restricted to the roads when being walked.
3. Owners are responsible for picking up their pet's litter.
4. Pets must not be left unattended.
5. All municipal and provincial bylaws must be adhered to, specifically with respect to pit bulls.
Boats and Boat Trailers
1. Dry storage of boats, boat trailers or other equipment will only be stored in areas designated by management.
Boat trailers will be stored on the premises for a fee. All trailers must have the proper passes (tags) attached
to the trailer before they can be stored. Please do not park trailers near the docks.
Utility and Enclosed Utility Trailer Storage
1. Utility and enclosed utility trailers will only be stored in designated areas on the premises for a fee. All trailers
must have the proper passes (tags) attached to the trailer before they can be stored. Please do not park trailers near
the docks.
Dock Boxes and alterations to the dock slips
1. To be of a make and model approved by management.
2. All alterations must be communicated to management and approved in writing before commencing. This
would include ladders, ramps, steps and carpeting.
3. Household electrical appliances such as bar fridges, washing machines ect, are not to be used inside of dock
boxes. They can create a fire hazard.
Camp Fires
1. Camp fires are NOT permitted near the gas docks due to the potential fire hazard.
Trees
1. Cribbing or building up the area at the base of the trees with topsoil is prohibited as this limits the oxygen to
the roots and eventually kills the trees. Hanging articles from trees is prohibited. Cutting of trees or removal
of bark is prohibited. Contact management for assistance when trees need trimming.
Hydro, Water and Sewage
1. Lights must be turned off when retiring for the night.
2. Leaking water hoses are prohibited.
3. Water supply taps must be turned off when you intend being away a day or more in case of hose breakage.
4. No changes to the hydro installation of Mitchell’s Bay Marine Park Limited are allowed until it has been
approved in writing by the operator. At that time, we will ensure that the proper changes in your contract are
completed and our electrician will be authorised to complete the work. "Any unauthorised changes
are grounds for evictions from the park".
5. All electrical equipment being used must be CSA approved.
Garbage
1. Garbage must be placed in tied plastic bags and deposited in the garbage bins. Only household garbage is
allowed. All other garbage must be taken home. At no time are individuals to bring garbage from off the
property and dump in the containers located at the marina and trailer park. Abuse of these rules is grounds
for eviction from the park.
Washrooms and Showers
1. Washrooms are available 24 hours a day from May until October for the convenience of the Park and Marina
patrons and their guests only. Washrooms and showers are behind the bait shop for the use of marina
patrons. There is a key pad code that is given out each year. Inquire at the office, gate or bait shop for
the code.
2. Users of these facilities are respectfully requested to help keep them clean and tidy for the benefit of others as
well as themselves. Please report any problem or abuse to the manager immediately.
3. Please do not flush napkins, tampons or paper towels down the toilet. Place them in the container provided.
4. We would ask that you remind all family members that we can evict the family of any person caught defacing
our washrooms or other property. You are responsible for the actions of your guests. Any infractions on their
part could lead to your eviction from Mitchell's Bay Marine Park Limited.
Clubhouse
The clubhouse is for the use of seasonal patrons from May until October. We only ask that it be left clean
and tidy after its use. (There is a fee for clean-up.)
Please advise the office of any functions you would like to plan in order that they can be added to the
schedule. (There is a fee of for rental)
Bulletin Board
1. Notices are to be approved by the office. Only information of interest to Park and Marina patrons will be
posted on the bulletin board located in the clubhouse.
2. Any signs posted in the marina basin must be approved by management. All non-approved signs will be
removed.
Quiet Hours
1. Quiet hours are 11:00 p.m. to 9:00 a.m. daily.
Renting
1. Renting or loaning of dock slips to friends or relatives is not allowed. If in doubt check with the operator.
The slip is intended for the occupants use only and for boats registered to them.
2. If your visitors need space for overnight camping, or overnight docking please contact the office and they
will provide an area for a nightly fee. Tents for camping are not allowed at any docks unless prior written
approval from management has been obtained.
3. Dining tents and gazebos are not allowed at the docks unless approval has been obtained in writing from the
office.
Selling
1. The Marina slip is not transferable.
2. A new signed lease agreement by the purchaser and Mitchell's Bay Marine Park Limited will have to be
completed.
3. The approval of the purchaser by Mitchell's Bay Marine Park Limited is not guaranteed.
4. No selling of merchandise of any kind by is allowed on the premises.
Lease Agreement
1. Mitchell's Bay Marine Park Limited reserves the right to refuse to renew the yearly lease agreement.
Safety
1. Possession of firearms or air guns in the Park is prohibited.
2. Parking on roadways is prohibited.
3. Young children must not be left unattended and must be accompanied by an adult when moving throughout
the Marina and Park.
4. Swimming in the Marina is prohibited.
5. The Chatham Kent Police Department and the Ontario Provincial Police have our permission to enter
the property at any time and have unrestricted access to operate throughout the facility.
Rates
1. Mooring rates by the season, month, week or day for services are as posted. Rates for other services are
available on request.
2. Seasonal rates must be paid in full as per the rate schedule and Mitchell’s Bay Marine Park Limited must be
in receipt of a signed contract prior to use of the facilities.
3. A copy of your boat(s) registration and proof of insurance must be received prior to the use of the facilities.
Refunds
1. The refund policy is attached to the rate schedule B. We ask that you read and understand these
policies prior to payment.
Loss, Damage and Injury
1. Liability for loss or damage to personal property or personal injury while on Park premises is solely the
responsibility of the occupant and guests.
Eviction
1. Failure to observe the foregoing rules and regulations may be grounds for eviction from the Park or Marina
without refund or compensation.
2. Infractions under civil law or criminal code committed on the Park premises will also result in immediate
eviction.
Insurance
1. The owner assumes liability for all claims arising as a result of the damage, injury, or death to property or
persons of the Mitchell’s Bay Marine Park Limited, its servants, agents, customers or tenants or their
guests, resulting directly or indirectly from the owner's negligence. The use by the owner and his guests
of the facilities of Mitchell's Bay Marine Park Limited shall be at the sole risk of the owner, and the owner
covenants to indemnify and save harmless Mitchell's Bay Marine Park Limited, its servants, agents or
employees, against any claim for loss or damage arising out of the use of the Marine facilities or
equipment or the handling of any boat anywhere at the Marina property by the owner or his servants,
agents or employees.
2. It is further agreed that the owner will insure his boat for the full value as well as carry liability insurance
coverage.
